Terms of Service

1. The service
Teleport: Spot (“Spot,” “we,” “our,” or “us”) is a 360° observation game by Teleport. These terms govern your use of the Spot app and related services at spot.teleport.eco and spot-api.teleport.eco. By downloading, accessing, or using Spot you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Spot.
Please read Section 19 carefully. It requires most disputes to be resolved by individual binding arbitration rather than in court, and it waives your right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these terms.
We may modify these terms at any time. Changes take effect when posted on this page, and material changes will be highlighted in the app or here. Continued use after changes means you accept them.
2. What Spot does
- Play 360° rounds: spot the object that doesn’t belong, or find real items a creator tagged.
- Capture your own 360° rooms and place objects or tag items in them.
- Play the Daily Challenge, duels, and online multiplayer matches with other players.
- Share rooms and reaction clips with friends or publicly.
- Discover business venues on the map, collect Passport stamps, and climb leaderboards.
3. Eligibility
You must be at least 13 years old to use Spot. If you are under the age of majority where you live, you may use Spot only with the involvement of a parent or legal guardian, who accepts these terms on your behalf. You are responsible for complying with the laws that apply where you use Spot.
4. Accounts
Accounts are optional and store only your game progress, profile, friends, and content you choose to upload. You may sign in with Apple, Google, or an email address and password. You are responsible for activity on your account and for keeping your credentials secure. You may delete your account at any time from Profile → Account → Delete account.
Playing without an account is supported; progress made that way stays on your device and cannot be recovered if you delete the app or change devices.
5. Your content
Rooms you capture stay on your device unless you sign in and back them up. Publish only spaces you own or have permission to share, without personal information; detectable faces are blurred automatically. You keep ownership of your content and grant Teleport a worldwide, non-exclusive, royalty-free license to store, host, process, adapt, and display it — including generating thumbnails, previews, watermarked exports, and blurred versions — as needed to run the service and as described in the two paragraphs below. That license ends when you delete the content, except for copies already shared by others, material already used in promotion as described below, or copies retained as required by law.
Promotional use of public content
Content you choose to make public — public rooms, published venue rooms, clips you keep, and your public profile name and avatar — may also be used by Teleport to promote Spot: in screenshots, trailers, App Store and store-listing assets, social posts, our websites, and press materials. We credit you by username wherever the format allows. Private and friends-only content is never used this way, and neither are your email address, location, or anything else that isn’t already public in the app. If you’d rather a particular piece of public content not be used, make it private, delete it, or email us and we will stop using it going forward — though we can’t recall material that has already been printed, published, or distributed.
Internal use
We may use content you upload, and data about how rooms are played, internally to operate, debug, secure, and improve Spot — for example tuning difficulty, testing renderers, measuring solve rates, and improving item detection and automatic face blurring. Internal use stays internal: we do not sell your content or your personal information, and we do not give it to third parties for their own purposes. Anything we publish or share outside the company from this work is aggregated or de-identified so that it does not identify you or your private spaces.
You represent and warrant that:
- You own or have the necessary rights and permissions to everything you upload.
- Your content does not infringe the intellectual property, privacy, or other rights of any third party.
- You have permission to capture and publish the space shown, and consent from any identifiable person in it.
- Your content complies with all applicable laws.
We may remove content that violates these terms.
6. Capturing spaces and venues
A captured room is a photographic record of a real place. Capture only spaces you own, occupy, or have permission to record, and never capture people without their consent. Publishing a business venue to the Spot map states that you are authorized to represent that venue or have its permission to publish it. We may remove any venue, room, or pin at the request of the property owner or occupant.
7. Acceptable use
By using Spot, you agree that you will not:
- Upload unlawful, infringing, harmful, hateful, defamatory, sexually explicit, or otherwise objectionable content.
- Capture private spaces or people without consent.
- Harass, threaten, impersonate, or abuse other players, or misrepresent your affiliation with any person or entity.
- Attempt to disrupt, reverse engineer, decompile, or abuse the service, its servers, or its networks.
- Cheat, exploit bugs, automate gameplay, or manipulate scores, streaks, leaderboards, achievements, or duel rewards.
- Use bots, scrapers, or automated systems to access or collect data from Spot without written permission.
- Collect or harvest other players’ personal information without their consent.
- Use Spot for spam, unsolicited marketing, or fraudulent activity.
We may suspend or terminate access for anyone we determine is not complying with these terms.
8. Community content and moderation
Rooms, clips, comments, profiles, and item labels created by other players are user-generated content. We do not endorse it and we are not responsible for it. Every piece of public content can be reported from the app, and you can block another player at any time; blocked accounts disappear from your feeds in both directions. Reported content may be hidden automatically pending review, and we may remove content or accounts that violate these terms without prior notice.
9. Purchases
Spot Pro is a one-time in-app purchase processed by Apple and tied to your Apple ID. Prices are shown in the App Store before purchase, and may change. Refunds are handled by Apple under the App Store terms — we cannot issue them directly. Restoring a purchase on a new device is done through the app’s Restore option.
Spot Pro unlocks additional object slots, custom uploads, sticker sharing, Pro venues, and removes ads. Free features — including the Daily Challenge and multiplayer — are not gated behind it. We may change which features Pro includes, but we will not remove access to a feature that was the substantive reason for an existing purchase without offering a comparable replacement.
10. Intellectual property
Spot, its design, artwork, mascot, bundled 3D objects, software, and the Teleport name and logo are the property of Teleport or its licensors and are protected by copyright, trademark, and other laws. Except for content you create, you may not copy, reproduce, republish, distribute, sell, license, or otherwise exploit any part of Spot without our written consent. All other trademarks and product names referenced in the app belong to their respective owners, and their appearance does not imply endorsement or sponsorship.
11. Copyright complaints
If you believe content on Spot infringes your copyright, send a notice to legal@teleport.eco including:
- Your full legal name, address, telephone number, and email address.
- A physical or electronic signature of the copyright owner or an authorized agent.
- Identification of the copyrighted work you claim was infringed.
- Identification of the material on Spot claimed to be infringing, with enough detail for us to locate it.
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner’s behalf.
12. Third-party services
Spot relies on third-party services — including Apple (sign-in, in-app purchase, push notifications), Google (sign-in), and cloud hosting and storage providers — and may link to third-party sites. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms.
13. Feedback
If you send us comments, feedback, or ideas about Spot, we may use them for any purpose without compensation, acknowledgement, or payment to you.
14. Service availability
We work to keep Spot running well, but we do not guarantee:
- Uninterrupted or error-free operation of the app or its services.
- Compatibility with every device or operating system version.
- Continued availability of any specific feature, room, venue, or piece of content.
- Permanent storage of content, or that backups will always be recoverable.
We may modify, suspend, or discontinue any part of Spot at any time, with or without notice.
15. Termination
By you
You may stop using Spot at any time and delete your account from Profile → Account → Delete account. Deletion permanently removes your account and its server-side data; see the Privacy Policy for what that covers.
By us
We may suspend or terminate your account and access to Spot at any time, without prior notice or liability, if you violate these terms, engage in fraudulent, abusive, or illegal activity, or where required by law. Paid entitlements are not refunded when an account is terminated for a violation.
16. Indemnity
You agree to defend, indemnify, and hold harmless Teleport, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from: (a) your use of Spot; (b) your violation of these terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you capture, upload, or share through Spot.
17. Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that Spot will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any content — including panoramas, captures, and automatic face blurring — is free from defects.
Play safely. Spot involves moving a device around real environments and, in AR mode, walking through real spaces. Stay aware of your surroundings, obey local rules, and do not play while driving or anywhere it would be unsafe. You are responsible for your own safety and that of the people around you.
18. Limitation of liability
To the maximum extent permitted by law, Teleport is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use Spot, even if advised of the possibility of such damages. Our total liability for any claim relating to these terms will not exceed the greater of the amount you paid us in the twelve (12) months before the event giving rise to the claim, or USD $50.
19. Dispute resolution and binding arbitration
This section requires you and Teleport to arbitrate disputes individually, and limits how you can seek relief from us. You are giving up your right to sue in court, to a jury trial, and to bring or join a class action. Read it before you accept these terms.
Talk to us first
Most problems are faster to fix by email. Before starting an arbitration, send a written notice of the dispute to legal@teleport.eco describing the claim and the relief you want, and give us 60 days to resolve it informally. We will do the same before bringing a claim against you. This step is required, and the 60 days toll any applicable deadline.
Agreement to arbitrate
If we can’t resolve it informally, you and Teleport agree that any dispute, claim, or controversy arising out of or relating to these terms, Spot, or your use of it — including its formation, interpretation, breach, or termination, and including claims that arose before you accepted these terms — will be settled by binding individual arbitration rather than in court. This agreement to arbitrate is governed by the Federal Arbitration Act and survives termination of your account.
How arbitration works
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this section. If the AAA is unavailable or declines to administer, you and Teleport will agree on another established administrator, or a court may appoint one. The arbitration will be conducted by a single arbitrator; unless you and Teleport agree otherwise, hearings will be held remotely or in the county where you live, and claims under the AAA’s desk-arbitration threshold may be decided on documents alone. The arbitrator’s decision is final and binding, and judgment on the award may be entered in any court with jurisdiction. The arbitrator may award the same individual relief a court could, and no more. AAA’s consumer fee schedule governs filing and arbitrator fees; where a claim is not frivolous, we will pay the portion of those fees that exceeds what filing in court would have cost you.
Class action waiver
You and Teleport may bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, consolidated, representative, or private attorney general proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of representative proceeding. If this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request is severed from the arbitration and must proceed in court, while all remaining claims stay in arbitration.
What is not covered
- Either of us may bring an individual claim in small claims court, so long as it stays there and remains individual.
- Either of us may seek injunctive or other equitable relief in court to stop infringement or misuse of intellectual property.
- Nothing here prevents you from reporting a concern to a government agency, or waives any right that cannot lawfully be waived.
Your right to opt out
You can decline this arbitration agreement. Email legal@teleport.eco within 30 days of first accepting these terms with the subject “Arbitration opt-out,” stating your name and the email or username on your Spot account. Opting out affects nothing else in these terms, and we will not treat it as a reason to close your account or change your service. If you opt out, Section 20 governs where disputes are heard.
Changes to this section
If we materially change this arbitration section after you accept it, you may reject the change by emailing us within 30 days of it being posted, and the version you originally accepted will continue to apply to you.
20. Choice of law
These terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. You agree to the personal and exclusive jurisdiction of the state and federal courts located in California for any dispute arising out of or relating to these terms or your use of Spot. If you access Spot from outside California, you do so on your own initiative and are responsible for compliance with local law. Nothing here removes any mandatory consumer-protection right you have under the law of your home country or state.
21. Changes
We may update these terms; continued use after changes means you accept them. Material changes will be highlighted in the app or on this page.
22. Severability and entire agreement
If any provision of these terms is found invalid, illegal, or unenforceable, the remaining provisions stay in full force. These terms, together with our Privacy Policy, are the entire agreement between you and Teleport regarding Spot and supersede all prior agreements and understandings.
